1. Acceptance of Terms

By accessing and using the Evergreenhillwhisper website and booking services, you agree to be bound by these Terms of Service, our Privacy Policy, and our Cookie Policy. If you do not agree to these terms, you may not use our services. We reserve the right to modify these terms at any time. Continued use of our services after modification constitutes acceptance of the updated terms.

2. Eligibility & Registration

You must be 18 years of age or older to make a booking through Evergreenhillwhisper. You are responsible for providing accurate and complete information during the booking process. You agree not to impersonate any person or entity or misrepresent your affiliation with any person or entity. Bookings made under false pretenses are subject to immediate cancellation without refund.

3. Booking & Reservations

All bookings are made through our website or by contacting us directly. Each booking is a contract between you and the property owner, facilitated by Evergreenhillwhisper. A booking is confirmed only when you receive a written confirmation from us. Booking details must be accurate. Any errors must be reported immediately. Evergreenhillwhisper is not liable for losses arising from inaccurate guest information.

4. Payment Terms

Payment is required in full at the time of booking unless otherwise stated. We accept credit cards, bank transfers, and other agreed payment methods. All prices are quoted in Japanese Yen (¥). Payment processing is handled by secure third-party providers. By providing payment information, you authorize the collection of funds from your account. All payments are final and non-refundable except as provided in our cancellation policy.

5. Cancellation Policy

Cancellation requests must be submitted in writing via email or contact form.

• More than 30 days before arrival: Full refund minus 10% administrative fee
• 15–30 days before arrival: 50% refund of booking amount
• 8–14 days before arrival: 25% refund of booking amount
• 7 days or less before arrival: No refund (100% cancellation fee)
• No-show: Full booking amount forfeited

Cancellations due to natural disasters, pandemics, or government travel restrictions may be eligible for full refunds or rebooking at no additional cost at our sole discretion. Proof of the triggering event is required.

6. Availability & Overbooking

We make reasonable efforts to maintain accurate availability information. In the unlikely event of overbooking, we will immediately notify you and offer alternative accommodations of equal or greater value at no additional cost, or a full refund. Evergreenhillwhisper is not liable for any losses, costs, or damages resulting from overbooking situations.

7. Guest Conduct & House Rules

Guests agree to:

• Respect property owners' rules as provided in booking confirmations
• Maintain the property in good condition and leave it clean upon departure
• Not engage in illegal activities or behavior that disturbs other guests
• Not bring pets unless explicitly permitted in the listing
• Not host additional guests beyond those listed in the booking
• Respect quiet hours (typically 22:00–08:00)

Violation of house rules may result in immediate eviction without refund. You remain liable for any damage caused to the property during your stay.

8. Liability & Damages

Guests are responsible for any damage caused to the property during their stay. Property owners are authorized to bill guests for repairs or cleaning necessitated by damage beyond normal wear and tear. Evergreenhillwhisper is not liable for personal injuries, lost belongings, or theft. We recommend guests obtain comprehensive travel insurance covering accommodation-related risks.

9. Disputes & Complaints

All disputes arising from bookings must first be addressed directly between the guest and property owner. If a resolution cannot be reached, guests may escalate complaints to Evergreenhillwhisper by submitting written details within 7 days of the alleged issue. We will investigate and attempt mediation. Our decision is final and binding in accordance with Japanese law.

10. Intellectual Property

All content on the Evergreenhillwhisper website, including text, images, logos, property descriptions, and design elements, are the property of Evergreenhillwhisper or its licensors and protected by copyright law. You may not reproduce, distribute, or transmit any content without our express written permission. Unauthorized use may result in legal action and liability for damages.

11. Limitation of Liability

To the maximum extent permitted by law, Evergreenhillwhisper shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our services or any booking, including but not limited to lost profits, lost data, or business interruption. Our total liability is limited to the total booking amount paid.

12. Third-Party Links & Content

Our website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of external sites. Your use of third-party services is governed by their terms and policies, not ours. We recommend reviewing such policies before engaging with external sites.

13. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of Japan. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Tokyo, Japan. You agree to submit to the personal jurisdiction of such courts for any disputes.

14. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall remain in full force and effect.
